General Provisions

The advertiser certifies that the contents of his advertising messages do not infrige any law, rule or legislation in force and that they do not contain any charge or allusion defamatory or prejudicial to a third party.

The advertiser guarantees AFRICAPHONEBOOKS and the television channels to that respect.

The advertiser is responsible for obtaining and paying all the rights and necessary authorizations for the use of the elements that he submits to AFRICAPHONEBOOKS for the execution of his advertising orders.

The advertiser guarantees to that respect AFRICAPHONEBOOKS and the television channels against any action or protest from a third party who would consider himself encroached upon his rights by the advertising messages on any ground whatsoever, including the case of damaged reception quality and this, whatever the mode of broadcasting or distribution of the television channels.

Besides, the advertiser recognizes and expressly accepts that the conclusion of an advertising order confers to the sales agent the right to broadcast the messages on the websites of the television channels being given the integral repetition of certain programs’ signal.

The advertisers mentioning websites, website addresses or telephone numbers certify that the contents of those sites and phone messages do not directly or indirectly countervene any right, or more generally the current legislation. In case the advertiser or the advertising sales agent is questioned as regards those websites or phone services, the sales agent may interrupt immediately the broadcasting of the messages concerned.

• Any protest as to the interpretation and/or execution of the present agreement, will be submitted to the Commerce Tribunal of Paris, only competent in that respect, notwithstanding plurality
  of defense counsels or appeal in guarantee.
